According to an MIT study a while back, only about 10% of patents granted in the United States have any meaningful commercial importance and less than one percent are of seminal importance. Nearly all new businesses aspiring to reach meaningful scale require some sort of outside funding to finance a competitive growth trajectory.

Jonathan Simkin: I was actually in high school when I decided I'd either start a company when I graduated, or go into patent law. They've got a program called Springboard, which helps really young companies get set up with mentors, and guides you through the startup process. He had the idea that people would want city guides to tell them where to eat and what to do. We talked about patents. I brought up the fact that I find many larger companies abusing the patent system to slow down smaller competitors which is actually anti competitive. So he founded … wait … CitySearch.

Whether it’s something as extensive as filing patents, more simple trademark registrations, and or putting appropriate documentation in place, don’t ignore this and don’t rely on boilerplate online templates. Make sure you have a lawyer to help draft your contracts and guide you’re communicating policies and procedures.

A startup-oriented lawyer may not be able to convince a jury of a guilty man’s innocence, but they can guide your adVenture through the menacing legal shoals it will no doubt face. Just as you would not ask your family physician to perform a coronary bypass, do not ask your corporate lawyer to help you write your patent application.
